Michael A. Airdo presented on The “As-Is” Clause and Protection from Third Party Claims at the Associated Equipment Distributors (AED) Summit in Las Vegas on Wednesday January 17, 2024. Michael talked about the importance of “as-is” language, what it is, and how to best use this language to protect the interests of your company and equipment from third-party claims.

The “As-Is” clause is a type used in contracts, agreements and sales transactions to disclaim implied warranties. Whether performing maintenance, repair, or preparing for re-sale, the use of “as-is” language in any contracts can assist in limiting a dealer’s exposure to liability from third parties.
