On July 14, Founding Member Mollie E. Werwas and Attorney Yuri A. Klinkenbergh will present “Document Retention, Preservation, and Discovery Readiness: Reducing Litigation Risk Before a Lawsuit Is Filed” at the LeadingAge Illinois 2026 Annual Conference.
As regulatory scrutiny and litigation exposure continue to evolve within the senior living industry, providers are increasingly being challenged to evaluate how everyday documentation and communication practices may later impact litigation and compliance obligations. This session will explore how record retention and preservation responsibilities extend well beyond resident care records to include financial documents, employee files, electronic communications, photographs, videos, and other materials that often become central evidence in litigation.
Drawing on real-world defense experience, Mollie and Yuri will discuss when preservation duties are triggered, how early response decisions following an incident can significantly affect exposure, and how proactive coordination within a facility and with defense counsel can help support compliance efforts while reducing unnecessary risk.
