Commissary Appointments and Civil Liability: What Religious Institutes Need to Know

We’re excited to share that Michael A. Airdo, Mollie E. Werwas, and Molly B. Hopkins recently published an article with the Resource Center for Religious Institutes exploring the civil law implications of appointing a commissary.

As commissary appointments become more common, religious institutes are encountering civil law questions that aren’t fully addressed by canonical decrees alone. The article looks at how the commissary relationship is viewed through a civil law lens and highlights areas where, without careful planning, providing institutes could face unexpected legal responsibility.

The authors offer practical, easy-to-apply guidance on how to better align civil governance documents with canonical realities, helping institutes reduce unnecessary risk while continuing to support communities during times of transition.
