We are pleased to share that Michael A. Airdo and Elvira K. Kovachevich recently published an article with the Illinois Association of Defense Counsel (IADC) titled: “Science, Storytelling, and the Law: Combatting Misinformation Ethically and Effectively.”
The article examines the growing influence of misinformation in litigation and public discourse and the unique challenges it presents for attorneys, jurors, and the justice system. Drawing on developments in science, psychology, and modern media, the authors explore how misinformation shapes narratives before and during trial, impacts the perception of expert testimony, and erodes trust in institutions traditionally grounded in fact.
Importantly, the article offers a framework for how attorneys can respond—ethically and effectively—by using responsible storytelling, evidentiary rigor, and strategic advocacy that respects professional obligations while addressing modern juror dynamics. It emphasizes the lawyer’s role not only as an advocate, but as a steward of truth in an era increasingly shaped by emotion-driven narratives and public skepticism.
